THE HON'BLE JUSTICE SRI T. SUNIL CHOWDARY CIVIL REVISION PETITION No.2209 of 2018 ORDER:

This Civil Revision Petition is filed by the tenants under Section 22 of the A.P. Buildings (Lease, Rent and Eviction) Control Act, 1960 (for short, 'the Act'), assailing the order dated 06.02.2018 passed in R.A.No.50 of 2017 on the file of the Additional Chief Judge, City Small Causes Court, Hyderabad, wherein and whereby the order dated 27.12.2016 passed in R.C.No.403 of 2012 on the file of the IV Additional Rent Controller, City Small Causes Court, Hyderabad ordering eviction of the petitioners herein from the petition schedule premises and handover the vacant physical possession of the same to the respondent-landlord, was confirmed.

At the time of arguments the learned counsel for the petitioners submitted that the petitioners are intending to vacate the petition schedule property on or before 31.12.2018. The learned counsel for the respondent also submitted that the petitioners may be granted time till 31.12.2018 to vacate the petition schedule property. In view of the submissions made by the learned counsel for both the parties, this Court is not inclined to go into the merits of the main case.

Having regard to the facts and circumstances of the case, the petitioners are directed to vacate the petition schedule property on or before 31.12.2018 and handover vacant possession of the same to the respondent. The learned counsel for the petitioners submitted that the petitioners will file an affidavit in R.C.No.403 of 2012 on the file of the IV Additional Rent Controller, City Small Causes Court,

Hyderabad to that effect, by the end of August 2018. It is made clear that no further extension petitions will be entertained by this Court under any circumstances.

The Civil Revision Petition is accordingly disposed of. No order as to costs. Consequently, miscellaneous petitions, if any pending in this Civil Revision Petition shall stand closed. __________________________ T.SUNIL CHOWDARY, J.
