THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 36417 OF 2016 O R D E R :

The petitioner, in this Writ Petition, seeks to assail the action of Respondents 2 to 4 in trying to grant permission to the 6th respondent to shift the existing bar and restaurant to Subashini Complex, Opp. to Bishop Church, Nandyala Road, Kurnool, without considering his objections dated 14.10.2016. It is stated that the petitioner has been running Meenakshi Bar & Restaurant in Jaya Complex, Nandyala Road, Kurnool. Now, the 6th respondent intends to shift his business to Nandyala Road. The petitioner objected to the said proposal, in view of the provisions of the Andhra Pradesh Excise (Grant of Licence of Selling by Bar and Conditions of Licence) Rules, 2005, which prohibit establishing a bar within 100 meters from educational institutions, places of public worship, etcetera.

According to the petitioner, near the proposed premises, a boys hostel and a church are located and further, it would affect his business also. Heard learned counsel for the petitioner as well as learned Government Pleader for Prohibition & Excise (Andhra Pradesh). Since it is claimed that the petitioner has already submitted to the 2nd respondent his objections dated 14.10.2016 for the proposed shifting of the bar and restaurant of the 6th respondent, the same be looked into and if it is found that the objections raised are worth consideration, the respondents are directed to take them into account, while entertaining the proposal of the 6th respondent, in accordance with law.

With this, the Writ Petition stands disposed of. No costs. Consequently, the miscellaneous Applications, if any shall also stand disposed of.
