28.08.2025 I.A.No.1 OF 2025 In Crl.P.Nos.73 and 3980 of 2020 These Interlocutory applications are filed praying this Court to relax the condition No.V of the orders dated 24.01.2020 passed in Crl.P.No.73 of 2020 and 18.09.2020 passed in Crl.P.No.3980 of 2020. Consequentially, he prayed the Court to permit the Petitioner to renew his passport bearing No.Z3595753 for a period of ten years while permitting the Petitioner to travel to USA to attend to the convocation ceremony of his daughter.

Learned counsel for the petitioner submitted that the petitioner's passport is due to expire within the next six months. He further submitted that the petitioner's daughter has completed her M.S. degree within one year, and her convocation is scheduled for December 2025. Therefore, he requested that the conditions be relaxed and that the petitioner be permitted to travel to the United States to attend his daughter's convocation ceremony.

On the other hand, learned Standing Counsel

submitted that any request for relaxation must be made before the trial Court, as the passport is currently deposited there. He further submitted that there is no convocation scheduled for December 2025. Accordingly, he requested this Court to pass an appropriate order. As submitted by learned counsel for the petitioner, since the passport is expiring within the next six months, the petitioner must initiate the process for its renewal. Hence, as the passport is in the custody of the trial Court, the petitioner may seek its release from that Court.

Considering the submissions made by the learned counsel for the petitioner and the learned Standing Counsel, and upon perusal of the material on record, it is observed that the petitioner seeks relaxation of conditions to enable him to travel to the United States to attend his daughter's convocation ceremony scheduled in December 2025. It is also submitted that the petitioner's passport, which is due to expire within the next six months, is currently deposited before the trial Court. The learned Standing Counsel opposed the request and contending that any such relaxation must be sought before the trial Court. In view of the above, the petitioner is directed to furnish before the trial Court the details of his proposed

travel, including the travel itinerary and relevant supporting documents, such as an invitation or confirmation of the convocation, if available. Upon such submission, the trial Court is directed to release the passport to the petitioner, subject to appropriate conditions to secure his return. The petitioner shall ensure that the renewed passport, if applicable, is re-deposited with the trial Court immediately upon his return or within the period specified by the trial Court. He is also permitted to approach the trial Court for any further permissions in this regard. It is made clear that the trial Court shall be at liberty to impose necessary conditions in accordance with law.

Accordingly, these Interlocutory Applications are ordered.
