HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.10485 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Roads and Buildings.

The petitioner complains of excess deduction of seignorage charges in respect of metal, sand and earth work/gravel contrary to the seignorage charges mentioned in Clause 100.1 of the contract.

Even if the averments of the petitioner are correct, the petitioner has to work out its remedies in terms of the contract, if there is any excess deduction of seignorage charges from its running bills. Therefore, this writ petition under Article 226 of the Constitution of India cannot be entertained. Hence, giving liberty to the petitioner to invoke appropriate remedy, the writ petition is dismissed. The miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
