THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.3516 of 2022 ABD CRIMINAL PETITION No. 3325 of 2022 COMMON ORDER:

These Criminal Petitions are filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking to enlarge the petitioners, who are arrayed as accused No.3 and 5 respectively, on bail in connection with Crime No.12 of 2022 on the file of WCO, Team-XIII, CCS, Hyderabad, registered for the offences punishable under Sections 409, 420, 465, 467, 468 and 471 r/w.34 of Indian Penal Code.

Heard the learned counsel for the petitioners and learned Assistant Public Prosecutor and perused the record. 3.

The facts of the case are that, a complaint was lodged by Branch Manager, Union Bank of India, Karwan Branch, stating that Telangana State Ware Housing Corporation, had opened two Fixed Deposit Accounts for a total sum of Rs.1,99,00,000/-, each totaling to Rs.3,98,00,000/- on 06.01.2021 and 07.01.2021 respectively and on 16.01.2021 the personnel of the said Corporation produced two receipts

for payment, and on examination it was found that the said FDRs are forged one. The petitioners and five others are the accused.

In the present crime Accused No.1 and 6 were granted bail on 10.3.2022 and 11.04.2022 respectively. The learned Counsel for the petitioners submits that Section 41-A Criminal Procedure Code notice was issued to Accused No.2, which is not disputed by the learned Additional Public Prosecutor. However, keeping in view the gravity of the offence, the Public Prosecutor argued that the relief of bail should not be granted to these petitioners.

However, for the reason of Accused No.1 and accused No.6 granted bail earlier, and also Section 41-A Criminal Procedure Code was issued to Accused No.2, and further the documents alleged to have been fabricated are in the possession of the police, as such the petitioners in both the petitions, who are, A3 and A5 are directed to be released on bail.

Accordingly, both the Criminal Petitions are allowed, and the petitioners i.e. Accused No.3 and Accused No.5 are directed to be released on bail on their each executing a personal bond for Rs.20,000/- (Rupees Twenty thousand

only) each with two sureties for a like sum each to the satisfaction of the XII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad.

Since the petitioner/Accused No.5 in Criminal Petition No.3325 belongs to Tamilnadu State, one local surety and one native surety shall be furnished by him. In the event of non-cooperation in the investigation, the Police are at liberty to move for cancellation of bail.

6. Accordingly, these two Criminal Petitions are disposed of.

As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
