HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 24407 OF 2004 ORDER :

When the matter is taken up for hearing, the learned counsel for the petitioner submits that the petitioner was appointed as Conductor. But the petitioner was asked to discharge the duties of Booking Clerk and Assistant Depot Clerk. But the petitioner was not extended the benefits of Conductor. During the pendency of the writ petition, the petitioner has attained the age of superannuation. The learned counsel for the petitioner submits that appropriate orders may be issued directing the respondents to consider the case of the petitioner for extending the benefits of conductor. The learned standing counsel appearing for the respondents contends that appropriate orders may be passed considering the case of the petitioner.

This Court, having considered the rival contentions made by the parties, is of the view that the Writ Petition can be disposed of directing the petitioner to submit a fresh representation to the respondents within two weeks from the date of receipt of a copy of this order and upon such representation being received, the respondents shall consider and pass appropriate orders in four weeks thereafter. With this direction, Writ Petition is disposed of. The Miscellaneous Petitions pending, if any, shall stand closed.
