Heard learned counsel for the petitioner; learned Government Pleader for Municipal Administration; and Sri A.Panduranga Rao, learned Standing Counsel appearing for respondent Nos.2 and 3. 2.

The case of the petitioner is that he is the absolute owner and possessor of property to an extent of 42.31 ankanas or 338.48 sq yards at D.No.23‐2‐84, Fathekhanpet, Nellore, having purchased the property through a registered sale deed vide document bearing No.6243/2013, dated 17.07.2013 from the GPA Holder. While so, on 07.10.2016 the authorities of the second respondent without issuing any prior notice or conducting enquiry are trying to demolish the compound wall and shed in the above premises. Questioning the said action of the respondents, petitioner has approached this court by this writ petition. 3.

Learned Standing Counsel submits that the respondent‐ authorities will follow due process of law.

In the facts and circumstances of the case, this court deems it appropriate to dispose of the writ petition directing the respondents to follow due process of law in the event the constructions made by the petitioner are found to be unauthorized and action for demolition requires to be initiated.

With the above direction, the writ petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
