THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN CONTEMPT CASE No.1356 of 2013 ORDER:

The undertaking, violation of which is alleged in this Contempt Case, is the undertaking recorded by this Court in C.A.No.771 of 2012 in C.P.No.108 of 2012 dated 28.09.2012 wherein the submission of the learned counsel for the respondent was recorded to the effect that the respondent-company had no intention of alienating their properties.

The present Contempt Case is filed alleging that, in violation of the said order, the respondents had inducted a new Director. The undertaking was only to not alienate the properties. The said undertaking did not prohibit the respondent from inducting a new Director to the Board of Directors of the company.

The Contempt Case as filed is wholly misconceived, and is accordingly dismissed. Miscellaneous petitions pending, if any, shall also stand closed. There shall be no order as to costs.
