THE HON'BLE JUSTICE G.SRI DEVI CRIMINAL PETITION No.3699 of 2019 ORDER:

This Criminal Petition, under Section 482 of Code of Criminal Procedure, 1973, is filed by the petitioner/accused seeking to relax the condition imposed in the order, dated 02.05.2019, in Crl.M.P.No.1436 of 2016 in Crime No.87 of 2017 on the file of Metropolitan Sessions Judge, Cyberabad, Ranga Reddy District at L.B.Nagar.

Heard the learned counsel for the petitioner/Accused and the learned Additional Public Prosecutor representing the respondentState and perused the record. 3.

The petitioner, who is an accused in the subject crime, filed an application under Section 439 Cr.P.C. before the Court below for grant of regular bail. The Court below, by impugned order, dated 02.05.2019, granted bail to the petitioner on some conditions. Operative portion of the impugned order reads as follows: "In the result, the petition is allowed.

The petitioner/accused is ordered to be released on bail on his executing a personal bond for a sum of Rs.20,000/- with two sureties for likesum each to the satisfaction of this Hon'ble Court. The petitioner is directed to submit copy of his Aadhar card for verification regarding its genuineness." 4.

Aggrieved by one of the conditions that the petitioner shall produce Aadhar card for verification, the petitioner filed this petition. 5.

Learned counsel for the petitioner/accused would submit that the petitioner is a poor labour and he did not possess the Aadhar card for producing the same into the Court; that though the petitioner was granted bail, till date he was not released on bail and hence, he prays to relax the said condition.

In view of the facts and circumstances of the case and considering the request of the learned counsel for the petitioner, the Court below is directed not to insist the petitioner/accused to produce his Aadhar card, but, however, the Court below shall accept Aadhar cards of the sureties at the time of release of the petitioner on bail. The remaining conditions imposed in the impugned order shall remain unaltered.

With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
