The petitioner claims to have purchased an extent of Ac.4.05 gts of dry land in Sy.No.139 situated at Enkapalli Revenue Village of Mahadevpur Mandal, Karimnagar District through registered sale deed dated 31.12.2014. Thereafter, the petitioner made an application dated 12.01.2015 to the 2nd respondent-Tahsildar, Mahadevpur Mandal for mutation of his name in the revenue records and for issuance of pattadar passbook and title deeds. As there was no action on his
application, the petitioner filed the present writ petition. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue (A.P.) for respondents.
A perusal of the application dated 12.01.2015 does not indicate that the same is in the prescribed format, i.e., Form-VI(A) as per the provisions of A.P. Rights in Land and Pattadar Passbooks Act, 1971. However, learned counsel for the petitioner asserts that all the necessary documents have been enclosed along with the application. Be that as it may, there is an acknowledgement/endorsement by the office of the Tahsildar dated 12.01.2015 evidencing that the petitioner had submitted the application on 12.01.2015. In other words, the petitioner's application has already been taken on file and it has been enquired into. In that view of the matter interests of justice would be met if a direction is given to the 2nd respondent to pass appropriate orders in accordance with law after completing the enquiry.
Accordingly, the writ petition is disposed of directing the 2nd respondent to consider the application dated 12.01.2015 submitted by the petitioner, complete the enquiry and pass appropriate orders in accordance with law. However, it is made clear that if there is any deficiency with regard to the documents submitted, and if any clarifications are required from the petitioner, he may be put on notice and shall be given an opportunity to submit the documents and explanation, if any. The entire exercise shall be completed as expeditiously as possible, preferably, within a period of three months from today. No costs. As a sequel, miscellaneous petitions, if any, shall stand closed.
