THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.12141 of 2018 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking verbatim the following relief: "For the reasons stated in the accompanying affidavit, it is prayed that this Honourable Court may be pleased to issue an appropriate writ more in the nature of Writ of Mandamus declaring the inaction of the Respondents 4 in not taking action on the complaint made by the Petitioner on 25/04/2017 and the complaint dated 23/03/2018 and equally inaction on the part of the Respondents 2 & 3 to give suitable instructions to the 4th Respondent Station House Officer as being arbitrary and illegal violating Article 14 and 21 of the Constitution of India and consequently direct the Station House Officer, the 4th Respondent herein to take appropriate action on the complaint of Petitioner and apprehend the named accused and take action as per law and issue such other Writ, order or direction and pass such other order or orders deem fit and proper in the circumstances of the case." 2.

I have heard the submissions of Sri Ch.Samson Babu, learned counsel appearing for the petitioner, and of the learned Government Pleader for Home (A.P.) appearing for the respondents 1 to 4. I have perused the material record.

At the hearing, learned Government Pleader for Home brings to the notice of the Court that a case in Crime No.51 of 2018 was registered, on 01.04.2018, by the Station House Officer, Payakaraopeta Police Station, Visakhapatnam District, for the offences punishable under Sections 341, 323, 506 read with Section 34 of Indian Penal Code, 1860, and Sections 3(1)(r), 3(1)(s), 3(2)(va) of the Schedule Caste and Schedule Tribes (Prevention of Atrocities) Act, 1989, and placed on record a copy of the said FIR.

In that view of the matter, learned counsel for the petitioner submits that the wit petition may be closed, as no further cause survives for adjudication.

Recording the submissions, the Writ Petition is closed. There shall be no order as to costs.

Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.
