There is no representation on behalf of the petitioner. The prayer in the writ petition is as follows: "..... to issue a writ, order or direction more particularly one in the nature of writ of Mandamus declaring the action of the respondents in not taking any action on the complaint submitted by the petitioner dt.12-04-2014 under RPAD against the 5th respondent is illegal and arbitrary, consequently direct the respondents to take necessary action on the complaint submitted by the petitioner dt.12-04-2014 and pass such other order or orders......"
Learned Government Pleader appearing for respondent Nos.1 to 4 placed on record written instructions dated 15.07.2014 issued by the Sub Inspector of Police, Habeeb Nagar Police Station, Hyderabad.
From perusal of the said written instructions, it is revealed that upon receipt of the petition submitted by the petitioner, an entry was made in the general diary of the Station stating that after conducting preliminary enquiry in the matter necessary steps will be taken on it. After conducting preliminary enquiry, a case in crime No.143 of 2014 for the offences punishable under Sections 420, 408 & 506 IPC was registered on the file of Habeeb Nagar Police Station on 14.07.2014 against one Mr. M.A. Majeed and investigation was taken up. In the said written instructions, it is further stated that the investigation is at the initial stage. Therefore, necessary action will be taken basing on the full fledged outcome of the investigation and accordingly an appropriate report
under Section 173 Cr.P.C. would be filed before the concerned Court.
In that view of the matter, this Court is of the opinion that no further cause would survive in the writ petition. Accordingly, the Writ Petition is closed. No costs.
