THE HONOURABLE SRI JUSTICE T.AMARNATH GOUD C.C.No.956 OF 2019 ORDER:

Respondents in person present and produced bankers' cheque in the name of Viquar Brothers and Brothers Enterprises and also submitted that in view of audit objection, the bank is not in a position to issue bankers cheque in favour of one person. However, learned counsel for the respondents' bank submitted that the bank has obtained the required documents with regard to the no objection certificate and also indemnity bond furnished with the bank.

Learned counsel for the petitioners represented that the person representing Brothers Enterprises is out of country and Viquar Brothers is available and it is ready to comply with the formalities.

In view of the above submissions and having regard to the facts and circumstances of the case, the respondents are directed to issue bankers cheque after completing formalities regarding indemnity bond and any other issue in favour of the Viquar Brothers. The bankers cheque presented before the Court is returned to enable the respondents to issue fresh cheque within three days from the date of receipt of a copy of this order. Accordingly, contempt case is closed. No costs. Miscellaneous petitions if any, pending shall stand closed. ______________________ T.AMARNATH GOUD,J 01.10.2019 kvrm
