JUDGMENT:

This appeal arises out of the judgment and decree, dated 29.12.2010, in O.S.No.8 of 2004 on the file of learned VII Additional District Judge (Fast Tract Court), Visakhapatnam. Sri P.V.Vidyasagar, learned counsel for the appellants, filed a letter, dated 09.02.2015, addressed to the Registrar (Judicial) stating that his clients have instructed him to withdraw the appeal as they have settled the dispute outside the Court.

At the hearing, Sri Y.Venkata Ramana, learned counsel representing Sri P.V.Vidyasagar, learned counsel for the appellants, has reiterated the aforesaid request.

In view of the fact that the dispute has been settled outside the Court, the request of the learned counsel for the appellants is accepted and accordingly, the Appeal Suit is dismissed as withdrawn. As a sequel to dismissal of the appeal suit, A.S.M.P.No.846 of 2011 filed by the appellants for injunction shall stand dismissed as infructuous.
