ORDER:

The order dated 11.02.2016 passed by the 2nd respondent suspending the authorization of the petitioner pending enquiry is under challenge in this writ petition.

The case of the petitioner is that he was appointed as fair price shop dealer of Shop No.4020 of Nimmapalli Village, Lonraopet Mandal, Karimnagar District and has been running the shop since 25 years. While so, the 2nd respondent issued show cause notice to the petitioner on 22.01.2016, to which the petitioner submitted a detailed explanation on 01.02.2016. Without considering the same, the 2nd respondent issued show cause notice on 11.02.2016 suspending the authorization of the petitioner pending enquiry. Hence the petitioner filed the present writ petition.

Learned counsel for the petitioner contended that the variation in ground stock and the stock register is within the permissible limit as provided under the Control Order, 2008.

A perusal of the explanation submitted by the petitioner does not indicate that the said contention has been made before the 2nd respondent.

However, considering the trivial nature of allegations made in the show cause notice that stocks available at the premises of the petitioner are not in conformity with the stock register, I deem it appropriate to direct the 2nd respondent to pass appropriate orders after giving an opportunity of hearing to the petitioner within a period of two weeks from today. The learned Government Pleader shall intimate to the 2nd respondent about the disposal of this writ petition. With the above direction, the writ petition is disposed of. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
