THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.13041 of 2019 ORDER:

Heard.

2. Petitioners claim to be the owners of land in survey Nos.267/1Aa, 268/2, 268/1, 267/A1 and 267/2 of Julurupadu Village & Mandal, Bhadradri Kothagudem District. In the writ petition, petitioners allege that though there are 350 standing palm trees, compensation is not paid to them for loss of palm trees and therefore they are entitled to compensation for loss of such trees also. Petitioners allege that even though the representation was made to pay compensation by duly taking note of the existing palm trees, the same is not acted upon and award copy is not furnished.

3. Learned Government Pleader produced a copy of the award in file No.B/222/2018-2 dated 27.02.2019. In page 9 of the said award, it is seen that there were negotiations with the land owners and consequent to the negotiations, a package deal was worked out to pay an amount of Rs.28,30,000/- which include benefits under R&R, livelihood, structure value, trees value, etc. in favour of petitioners herein.

4. Thus, it is seen from the award that the petitioners have agreed for settlement of the consolidated amount and the amount worked included the trees standing in the lands of the petitioners. Therefore, now, the petitioners cannot independently claim compensation for the trees having agreed for the consolidated amount paid to them.

5. Writ Petition is accordingly dismissed.

Miscellaneous Petitions pending in this Writ Petition, if any, shall stand closed. No order as to costs.
