Petitioner alleges that land to an extent of Acs.121.00 in Survey No.146//AA of Yadagiripally Village and Mandal belongs to him and the same is his ancestral property. He now alleges that the land to an extent of Acs.11.22 guntas is acquired by the Government in the process of developing Sri Laxmi Narasimha Swamy Temple in Yadagirigutta. He further alleges that award was passed and compensation was determined. At this stage, the present writ petition is filed alleging that compensation should be paid to the petitioner and not to the unofficial respondents, who are claiming as owners of the said land.

The averments in the affidavit filed in support of the writ petition itself would show that the revenue records would reflect the names of unofficial respondents and they were issued pattadar passbooks and title deeds. Aggrieved thereby, the petitioner claimed to have filed appeal and the same is pending. 4.

The petitioner has to assert his ownership on the land acquired by the Government before seeking to pay compensation. Even before he asserts his claim and when the revenue records reflect the names of unofficial respondents, no direction can be issued to the respondent authorities not to pay compensation to the unofficial respondents. There is no merit in the writ petition. The writ petition is accordingly dismissed leaving it open to the
