THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.3371 of 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Criminal Procedure Code by the petitioners/Accused Nos.1 to 3 in Crime No.16 of 2022 of Sarangapur (Nirmal) Police Station, Nirmal District, registered for the offences punishable under Sections 307, 506 r/w.34 of Indian Penal Code.

Briefly stated, the case of the Prosecution is that the petitioners who are Accused Nos.1 to 3 allegedly beat the brother of the defacto complainant on 28.02.2022. The reason for the said clash was in respect of rash driving in the lane and for the said reason the petitioners beat the brother of the defacto complainant and others.

Learned Assistant Public Prosecutor states that the injured were already discharged from the hospital after treatment.

Since the petitioners are in jail from 10.03.2022 they can be released on bail on the following conditions.

i. the petitioners/Accused Nos.1 to 3 are directed to be released on bail on their executing personal bonds for Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties each for a likesum, to the satisfaction of the Judicial First Class Magistrate, Nirmal.

ii. After release on bail, the petitioners/A1 to A3 shall appear before the concerned police station, on every Wednesday between 10.00 a.m and 11.00 a.m., for a period of three months or till filing of charge sheet whichever is earlier.

iii. The petitioner/accused No.1 shall comply with the conditions as laid down under Section 437 (3) of Cr.P.C.
