THE HONOURABLE SRI JUSTICE G.CHANDRAIAH C.R.P. No.3844 of 2015 ORDER:

This revision petition has been filed questioning the endorsement dated 03.09.2015 wherein it is stated that since the I.A. No.289/2015 was allowed on 15-6-2015 for the same relief, how the petition is maintainable, for explain. Time 7 days." From a perusal, the said endorsement was made by the concerned on the application, IASR. No.20600 of 2015, filed by the petitioner wherein sought to summon the Sub-Registrar, Vijayawada to produce the original mortgage deed

document No.1316 of 1964 dated 24.04.1964 and for consequently sending the said document to the Director, Forensic Laboratories for comparison with Ex.X8 (sealed cover 8/71), X9 (18.06.1971) and B5 (Promissory note date 18.09.1968), stating that the similar relief sought for in I.A. No.289 of 2015 was allowed on 15.06.2015 and therefore, how the said application is maintainable and granted seven days time for explanation.

It is clear from the above that the petitioner was given an opportunity of explanation with regard to maintainability of the application and the petitioner, in stead of recourse, explaining the objection, straight away filed this revision petition. In that view of the matter, without expressing any opinion on the merits of the application and as I do not find any reason to interfere with the endorsement that was made by the concerned, this revision petition is liable to be dismissed. Accordingly, this revision petition is dismissed. As a sequel, miscellaneous petitions, if any, stands closed. There shall be no order as to costs.
