HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.28231 of 2015 ORDER:
Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue.
The petitioner states that she is a widow of late Satyanarayana Reddy, who was an ex-serviceman and who was allotted the land admeasuring Ac.5-00 cents in Sy.No.21/2 situated at Kapavaram Village, Biccavolu Mandal, East Godavari District, in the year 1966 under ex-serviceman quota. She states that her husband was also issued pattadar pass Book No.433050/83. While he was in possession and enjoyment of the said land, he died on 03-10-2011 and thereafter, the petitioner is in possession and enjoyment of the said land and states that pattadar pass book was also transferred in her name on 02-09-2014. The petitioner seeks to alienate the said land for her family necessities and made an application to the 2nd respondent on 24-04-2015 under G.O.Ms.No.307, dated 06-06-2013.
The petitioner also states that the 2nd respondent has called for a report from the 3rd respondent and such report was already submitted to the 2nd respondent and, therefore, seeks early consideration of her application by the 2nd respondent. Since the petitioner's request for consideration of her application in terms of aforesaid G.O., is pending with the 2nd respondent, it is appropriate that the 2nd respondent takes an early decision in the matter and passes appropriate orders, keeping in view the family necessities mentioned by the petitioner. Accordingly, the writ petition is disposed of. No order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed. _______________________ VILAS V.AFZULPURKAR, J Date: 02-09-2015 Prv
