HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.19465 2017 ORDER:

Heard Sri G. Vasantha Rayudu, learned counsel for the petitioner and the Assistant Government Pleader (Revenue) for respondents.

2. This court is of the view that the writ prayer for the present is completely misconceived. The 2nd respondent after receiving a complaint on the alleged encroachment of the Government land by petitioner inspected the subject matter of the writ petition and has marked the alleged encroachments. Now the apprehension of the petitioner is that the 2nd respondent without recourse to law may either dispossess the petitioner or demolish the existing structures in the petition schedule property. Hence, the writ petition.

3. I have perused the writ affidavit and also the annexures filed by the petitioner. This court is not persuaded to examine writ prayer and is of the view that the writ petition is filed on apprehension or to prevent the respondents from protecting the land on which the government has right and interest.

4. Learned counsel for the petitioner submits that the 2nd respondent is not receiving explanation in this behalf or affording opportunity to petitioner. The statement made by the counsel is noted and liberty is given to petitioner to make representation to 2nd respondent on all aspects of the matter by enclosing a copy of this order and this court has no reason to doubt that the 2nd respondent will not enquire in to and proceed in accordance with law.

5. The writ petition is, accordingly, disposed of as indicated above. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence. ____________ S.V.BHATT, J Date: 15.06.2017 BSS
