THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.24548 OF 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India for the following relief:

"to issue a writ order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the Respondent No.4 in refusing to register my complaint dated 30-07-2015 against Respondent No. 7 as illegal arbitrary violative of principles of natural justice and against Article 14, of the Constitution of India and consequently direct the respondents No. 4 to register the complaint against Respondent No. 7 and pass such other order or orders as this Hon'ble court may deem fit and proper in the circumstance of the case."

When the matter is called today, written instructions dated 10.08.2015 furnished by the Sub Inspector of Police, Raidurgam Police Station, Cyberabad Commissionerate, have been placed on record by the learned Government Pleader for Home. In the said instructions, it is stated as follows:

"The petitioner herein has sent a petition dated 30.7.2015 through post to this respondent police station in and by which, he requested to initiate action against Mr.K.Shivaram Reddy for theft of cheque No.9 of account No.866010110002235, Bank of India, Film Nagar Branch and further issued notice dt. 17.7.2015 through his Advocate in the colour of cheque bounce.

Upon receipt of the said petition through post, an entry was made into the station general diary, stating that after conducting preliminary enquiry into the matter action will be taken.

After conducting preliminary enquiry into the matter, a case in Cr.No.253/2015 U/secs.379 r/w 420 IPC was registered on the file of Raidurgam Police Station on 8.8.2015 and investigation was taken up.

Mr.K.Shivaram Reddy-7th respondent herein is

shown as accused in the FIR.

The investigation is at the preliminary stage. Necessary steps will be taken against the accused in the FIR depending on the evidence adduced during the course of investigation. An appropriate report U/sec.173 Cr.P.C will be filed before procedure the concerned Hon'ble Court as expeditiously as possible by following the due proecure.

I humbly submit that action was taken on the complaint dt 30 7 2015 (sent by post) by registering an FIR No.253/2015 dt.8.8.2015 after conducting preliminary enquiry into the petition.

I humbly submit that almost all the averments made in the affidavit filed in support of the writ petition are the subject matter of investigation in Cr.No.253/2015 dt.8.8.2015 for which, a detailed investigation is under progress.

I assure to this Hon'ble Court that the investigation will be completed at the earliest by following the due procedure as contemplated under law."

4. In view of the above written instructions, writ petition stands disposed of. Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs.
