HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.3897 of 2018 ORDER:

This Criminal Petition is filed by petitioners/A1 to A3 under Section 482 Cr.P.C, to quash the proceedings against them in C.C No.345 of 2017, pending on the file of First Metropolitan Magistrate, Visakhapatnam, registered for the offences under Section 498 (A) IPC and Section 4 of Dowry Prohibition Act, 1961.

Having regard to the fact that the matter is now coming up for appearance of the parties and then for framing of charges, this Court considers it not apposite to quash the proceedings at this stage. However, liberty is given to petitioners/A1 to A3 to move an appropriate application seeking for discharge, in which case, the trial Court shall pass an appropriate order on merits. Considering the submission of petitioners/A1 to A3 as they are residents of Ongole, their appearance before the trial Court is dispensed with. Accordingly, the Criminal Petition is disposed of.
