THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.41534 of 2015 ORDER:

The petitioner is stated to have applied for grant of pattadar pass books and title deeds with regard to Ac. 1.34 cents in Survey No.179/C of Thimmapuram Village, Yedlapadu Mandal, Guntur District. Since no orders were passed on the said application, the petitioner made a request under the Right to Information Act, 2005, by his representation, dated 14.10.2015. The said request has since been considered and an endorsement is given to the petitioner, dated 13.11.2015, rejecting the petitioner's application. However, learned counsel for the petitioner states that no orders so far are passed under the Rights in Land and Pattadar Pass Books Act, 1971 (ROR Act) with reference to his application for grant of pattadar pass books and title deeds and on account thereof, he is not in a position to avail further remedies available to him under law.

2. Heard learned counsel for the petitioner. He states that in view of the reply already given to the petitioner under the Right to Information Act, 2005, the 3rd respondent shall pass appropriate orders on the petitioner's application.

3. The Writ Petition is, accordingly, disposed of, directing the 3rd respondent to consider the petitioner's application as aforesaid and pass appropriate orders and communicate the same to the petitioner, preferably within a period of two (2) weeks from the date of receipt of a copy of this order. After communication of the said order, the petitioner is at liberty to avail appropriate remedy available to him under law. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
