HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.9093 of 2017 ORDER:

Heard learned counsel for the petitioner, learned Public Prosecutor and perused the record.

This Criminal Petition is filed to quash the proceedings in Crime No.145 of 2017 on the file of Pedavegi Police Station, Pedavegi, West Godavari District.

Learned counsel for the petitioner would submit that there are no allegations constituting the offences punishable under Sections-447, 354, 506 and 328 I.P.C. and therefore, Crime No.145 of 2017 is liable to be quashed.

On the other hand, the learned Public Prosecutor opposed the said submissions of the learned counsel for the petitioner. There is record to show that on 06.7.2017 at 2.30 pm., when the de facto complainant was at her fields, the petitioner trespassed into her land, made an attempt to out rage her modesty and in that process, it appears that he tore her hair and threatened her with dire consequences.

In view of the above allegations, it is not a fit case to quash the F.I.R. The Criminal Petition is devoid of merits and hence, the same is dismissed.

As a sequel, the Miscellaneous Petitions, if any, shall stand dismissed.
