This petition is filed, under Sections 437 and 439 of the Code of Criminal Procedure, 1973, to release the petitioneraccused No. 4 in S.C.No. 215 of 2017 on the file of the Court of Principal Sessions Judge, Medak at Sangareddy (for short, 'the Court below'), registered for the offences punishable under Sections 120-B, 395, 201, 411, 414 read with Sections 34 and 109 of IPC and Section 25 (B) (A) of Arms Act. 2.

Heard learned counsel for the petitioner and learned Public Prosecutor (T.S.).

As seen from the material on record, the specific role played by the petitioner is that he, being a bullion merchant at Bombay, financed the other accused to commit dacoity with an agreement to sell the booty to him at 50% of its value and accordingly, he gave Rs.5,00,000/ - to the other accused. 4.

Learned Public Prosecutor submits that major part of trial is completed and the case is posted for recording of evidence of investigating officer and that the petitioner hails from Mumbai and in case he is released on bail at this stage, it is difficult for the Court below to complete the trial.

Having regard to the facts and circumstances of the case, the Court below is directed to complete the trial in S.C.No. 215 of 2017 pending on its file and decide the same in accordance with law at the earliest and in any event not later than two months from the date of receipt of a copy of this order.

Subject to the above, the criminal petition is dismissed. Pending miscellaneous petitions if any shall stand dismissed in consequence.
