Balaswamy Sripuram v. The Public Prosecutor

THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.3340 of 2022 ORDER:

This Criminal Petition under Section 438 Criminal Procedure Code is filed by petitioners, who are arrayed as Accused No.1 to 15, seeking bail in the event of their arrest in connection with Crime No.68 of 2022 of Kollapur Police Station of Nagarkurnool District registered for the offences punishable under Sections 307, 341, 427, 147 and 148 read with Sections 149 of Indian Penal Code.

Heard the learned Counsel appearing for the petitioners and learned Assistant Public Prosecutorrespondent, for the State. 3.

As seen from the record, regarding the very same incident case and counter case were filed by both parties. There is no mention of details of the injuries received by the de facto complainant, nor any medical

certificate is filed. In the back ground of the disputes between the villagers, in support of different political parties, and also for the reason of there being no injuries, the petitioners can be released on bail on their surrender.

Accordingly, this Criminal Petition is allowed. The petitioners/A1 to A15 shall be released on bail, on their surrender within ten days, in connection with Crime No.68 of 2022 of Kollapur Police Station, Nagarkurnool District, on their executing self bond for Rs.10,000/- (Rupees ten thousand only) each with two sureties for a like sum each to the satisfaction of the Station House Officer, Kollapur Police station.

Further the petitioners shall appear before the Station House Officer, Kollapur on every Wednesday and Sunday for a period of three months.

Since it is stated by the learned Counsel for the Petitioners that complaints were lodged against the

SHO for harassing the petitioners herein, the S.H.O is directed to mark the appearance of the petitioners whenever they attend police station and send them, when not necessary for the purpose of investigation. _________________ K.SURENDER, J 13.04.2022 Note: Issue CC today.
