When the matter is taken up for hearing, it is noticed that the writ petition against the 2nd respondent is dismissed for default vide office endorsement dated 20.05.2015. Thereafter, no steps have been taken by the petitioner to restore the name of the 2nd respondent as a party to the writ petition.

When the petitioner is challenging the order passed by the 1st respondent in favour of the 2nd respondent, without restoration of the name of the 2nd respondent, who is a proper party to the writ petition, the writ petition cannot be adjudicated on merits.
