HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

The Fair Price Shop Dealership of the petitioner was suspended by the Sub-Collector, Khammam, dated 04.06.2019, on the allegation of violation of terms of authorization. Aggrieved thereby, petitioner claimed to have preferred appeal before the Joint Collector (CS) and also filed application praying to grant stay. The appeal as well as stay application were received by the Office of Joint Collector on 19.06.2019. Soon thereafter, this Writ Petition is filed.

Since remedy of appeal is available and petitioner has already availed remedy, this Court is not inclined to entertain the Writ Petition. Further, it cannot be said that there is inordinate delay in considering the application as appeal was preferred only on 19.06.2019. Therefore, no time limit can be prescribed. However, 2nd respondent is directed to expedite hearing and take action on the appeal preferred by the petitioner within the time frame.

Writ Petition is accordingly disposed of.

Pending miscellaneous petitions shall stand closed.
