HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITON No. 6438 of 2006 O R D E R:

The grievance of the petitioners is that even though they are fully eligible and qualified for promotion to the post of Electrician DC (Mechanic), the respondent did not consider their case for promotion. Learned Standing Counsel for respondent-Corporation submits that since the petitioners did not pass the trade test as stipulated in the Rules of the Corporation, their cases for promotion to the post of Electrician cannot be considered.

In that view of the matter, ends of justice would be met if the petitioners are directed to submit a representation seeking promotion to the post of Technician within a period of two weeks form the date of receipt of a copy of the order and in such case, the respondent authorities shall consider and pass appropriate orders in accordance with law within a period of four weeks thereafter. With the above direction, the writ petition is disposed of. No costs.

Miscellaneous Petitions, if any, pending in this writ Petition shall stand closed.
