Challa Pitchaiah v. The State Of Andhra Pradesh
THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION NO.7141 of 2015 Between:
1. Challa Pitchaiah and others PETITIONERS AND
1. State of Andhra Pradesh, rep. by its Principal Secretary, Revenue Department, A.P., Secretariat Buildings, Hyderabad, and others.
RESPONDENTS
ORDER:
The grievance of the petitioners is that they belong to weaker sections and are landless poor persons and that they are eligible to grant house site pattas. They submitted representation dated 02.08.2012 to the Agricultural Minister and the same was forwarded to the 3rd respondent, who in turn forwarded the same to the 4th respondent on 2.05.2013 directing him to enquire into the matter and submit a report. The said representation was forwarded to the Mandal Revenue Inspector, who after enquiry submitted list of 273 eligible candidates to the 4th respondent for allotment of house site pattas. Though proceedings Rc.No.380/2013, dated 10.12.2013 has been received by the 3rd respondent, no steps have been taken to allot house site pattas to them. Hence they filed the present writ petition.
Heard learned counsel for the petitioners and learned Assistant Government Pleader for Revenue (A.P.) for respondents. Considering the limited grievance of the petitioners, interest of justice would be met, if a direction is issued to the respondents to consider the representation made by the petitioners dated 2.08.2012 in accordance with the schemes available subject to their eligibility. Accordingly, the writ petition is disposed of directing the respondents to consider the representation dated 02.08.2012 submitted by the petitioners in accordance with the schemes available, subject to their eligibility and pass appropriate orders on the same in accordance with law. No costs. As a sequel, miscellaneous petitions, if any, shall stand closed.
