HONOURABLE SRI JUSTICE M.LAXMAN CRIMINAL PETITION NO.4711 OF 2023 ORDER :

The present application under Section 438 Cr.P.C is filed by the petitioners/accused Nos.1 to 4 seeking anticipatory bail in the event of their arrest in connection with Crime No.56 of 2023 of Venkatapuram Police Station, Mulugu District, registered for the offences punishable under Sections 447, 294(b), 324, 506 r/w 34 IPC. 2.

The case of the prosecution is that there are civil disputes between the injured and the petitioners with regard to the house and open land. In this regard, the accused allegedly trespassed into the house site, abused and beat the victims and caused injuries. 3.

Learned counsel for the petitioners has contended that the petitioners were falsely implicated in order to settled the civil disputes which are pending between them and the alleged offences are punishable lesser than seven years and that custodial interrogation is not required.

Learned Additional Public Prosecutor opposed the bail. 5.

Having regard to the fact that there is existence of civil disputes between the parties and further, the offences are punishable below seven years and the injuries sustained are also not serious in nature and the custodial interrogation is not required, this court is inclined to grant anticipatory bail to the petitioners/accused Nos.1 to 4 on certain terms.

Accordingly, the Criminal Petition is allowed on the following terms and conditions:

(i) The petitioners - accused Nos.1 to 4 are directed to surrender before the Station House Officer, Venkatapuram Police Station, Mulugu District, within a period of fifteen days from today and on such surrender, they shall be released on bail on their executing personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties for a like sum each to the satisfaction of the same Station House Officer.

(ii) that the petitioners/accused Nos. 1 to 4 shall appear before the concerned SHO on every fortnight between 8.00 am to 8.00 pm for a period of two months or till filing of the charge sheet, whichever is earlier.

(iii) that the petitioners/accused Nos.1 to 4 shall not tamper with the prosecution witnesses.

(iv) that the petitioners/accused Nos.1 to 4 shall co-operate with the investigating agency.

(v) that the petitioners/accused Nos.1 to 4 shall not misuse the liberty granted to them.
