HON'BLE SRI JUSTICE R.SUBHASH REDDY AND HON'BLE SRI JUSTICE A.SHANKAR NARAYANA WRIT PETITION No.39478 of 2015 ORDER : (Per Hon'ble Sri Justice R.Subhash Reddy) The limited relief sought in this writ petition is to declare the action of the In-charge Presiding Officer of Debts Recovery Tribunal, Vizag, in insisting the parties to appear before Kolkata for disposal of the applications pending in S.A.No.53 of 2006 & S.A.No.40 of 2010, as illegal.

Heard learned counsel for the petitioner and also the learned counsel appearing for the respondent - Bank.

It is submitted that presently there is no Regular Presiding Officer for Debts Recovery Tribunal, Vizag. Since the Presiding Officer of Kolkata is acting as In-charge Officer of Debts Recovery Tribunal, Vizag, he is taking up the cases of Debts Recovery Tribunal, Vizag, three days in a month. As the aforesaid S.As are filed before the Debts Recovery Tribunal, Vizag, there is no reason in asking the parties to appear at Kolkata. However, since the said S.As are old matters of 2006 and 2010, we deem it appropriate to dispose of the writ petition directing the In-charge Presiding Officer of Debts Recovery Tribunal, Vizag to dispose of the said S.As within a period of six weeks from the date of receipt of this order, by hearing the parties at Vizag.

Subject to the above, the Writ Petition is disposed of. No order as to costs.

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
