Smt, Aluri Savithramma, v. State Of Andhra Pradesh, Rep. By Its Secretary,
THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.20931 OF 2016 ORDER:
The case of the petitioner is that she is cultivating agricultural lands covered by RS No.1238 to an extent of Ac.453 cents situated at Kamavarapukota Mandal & Village, West Godavari District, being the assignee in the year 1999, and pattadar pass books and title deeds were also issued in her favour and her name is also reflected in the ROR 1B register. While so, the 5th respondent (since deceased) now represented by his sons, respondents 6 and 7, filed a petition before the 3rd respondent-RDO, Eluru, alleging that the petitioner was not entitled for assignment of the land in question as she was not a resident of the village and she owns lands elsewhere.
Acting on the petition, the 3rd respondent after calling for reports from the 4th respondent-Tahsildar, Kamavarapukota Mandal, and even though the 4th respondent submitting reports to the effect that the petitioner has been assigned the lands by the Assignment Committee after due enquiry, the 3rd respondent-RDO, Eluru, by order dated 11-032002 cancelled the patta granted in favour of the petitioner.
before the 2nd respondent-Joint Collector, Eluru, who after examining the records set aside the orders of the 3rd respondent-RDO, Eluru, against which the party respondents filed appeal to the Chief Commissioner of Land Administration (CCLA), Andhra Pradesh, Hyderabad, and in appeal, the Chief Commissioner of Land Administration set aside the orders of the 2nd respondent-Joint Collector and remanded the matter for denovo enquiry and to pass appropriate orders thereon.
2. The grievance of the petitioner is that though the matter is heard and orders are reserved on 26-11-2011 and the matter again was re-opened, heard and reserved on 03-03-2012, no orders have been passed in revision in C.No.7520/2006/(E1) by the 2nd respondent-Joint Collector till date. Hence, this writ petition.
3. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue.
4. Inasmuch as the grievance of the petitioner is only against the inaction in disposing of the above revision, pursuant to the remand, by the 2nd respondent, ends of justice would be met if a direction is given to dispose of the same. In the circumstances, writ petition is disposed of directing the 2nd respondent-Joint Collector, Eluru, to dispose of the revision in C.No.7520/2006/(E1), and pass appropriate orders thereon, in
accordance with law, within a period of three months from the date of receipt of a copy of this order. Miscellaneous petitions, if any, pending in this writ petition shall also stand disposed of. No order as to costs.
