HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 31078 of 2011 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue appearing for the respondents. With the consent of the parties, the writ petition is disposed of at the admission stage itself. The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in threatening to dispossess the petitioner from the land admeasuring Acs.5.00 in Survey No.2487/1 situated at Pedda Orampadu Revenue Village, Obulavaripalli Mandal, Kadapa District, as illegal and arbitrary.

The case of the petitioner is that she being a landless poor person was allotted land on 12.10.1984 vide DKT patta No.941/1393 by the then Tahsildar,

Kodur Taluq, Kadapa District. It is stated that since then, the petitioner is in possession and enjoyment of the same and the respondents also issued pattadar passbooks and title deeds in favour of the petitioner in respect of the land assigned to her. It is also stated that the respondent authorities are now trying to dispossess the petitioner from the land on the ground that no patta was granted to her. Hence, the present writ petition.

The 3rd respondent filed his counter denying the averments made in the writ petition. It is stated that no patta was granted in favour of the petitioner in respect of the above land and that steps will be taken to dispossess her, in accordance with law.

Though various grounds are raised in the writ petition, the learned counsel for the petitioner restricts his prayer seeking a direction to the respondents not to dispossess the petitioner from the land, without following the due process of law. Having regard to the circumstances stated above and without going into the merits of the case, the respondents are directed not to dispossess the petitioner from the land admeasuring Acs.5.00 in Survey No.2487/1 situated at Pedda Orampadu Revenue Village, Obulavaripalli Mandal, Kadapa District, without following the due process of law.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.

Consequently, miscellaneous petitions pending if any in the writ petition shall stand closed.
