HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.27894 of 2016 ORDER:
Writ petition is filed questioning the inaction on the part of the 5th respondent-Tahsildar, Bheemgal Mandal, Nizamabad District, in issuing way bills for transportation of sand for constriction of 60 MLD water treatment plant and structures under Telangana Drinking Water Supply Project of SRSP Segment-12 in pursuance of the letter addressed by the 2nd respondent-Superintendent Engineer, TDWSP Circle, Nirmal, Adilabad District, as being illegal, arbitrary and in violation of principles of natural justice and for issuance of appropriate consequential directions.
2. Heard the learned counsel for the petitioner and the learned Asst. Government Pleader for Revenue.

Admittedly, the petitioner who claims to be a sand transporter, owing tipper vehicles, has no privity of contract with the 2nd respondent, but he is a sub-Contractor of Indian Hume Pipe Company Limited, Hyderabad, with whom the 2nd respondent entered into an agreement for certain works. The petitioner has not placed any material to show that respondents have violated any conditions of contract entered with him and under those circumstances, the petitioner has no locus standi to seek issuance of mandamus directing the 5th respondent to issue way bills
to enable him to transport sand to the project site. It is not discernable how the petitioner has got locus standi to maintain this writ petition in the absence of any enforceable right. In the circumstances, I am not inclined to entertain this writ petition and it is accordingly dismissed. Miscellaneous petitions, if any pending in the writ petition shall also stand dismissed.
