THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO WRIT PETITION No.7776 OF 2017 ORDER: (Oral) (Per the Hon'ble Sri Justice Suresh Kumar Kait) Vide the present petition, the petitioner seeks direction thereby directing the respondents to produce the wife of the petitioner viz., Smt K.Manaswitha, before this Court.
2. Pursuant to order dated 07.03.2017, the wife of the petitioner appeared before this Court on 13.03.2017.
3. On the said date, this Court has interacted with the petitioner and Manaswitha, who was born on 05.04.1995. She admitted her marriage certificate dated 30.11.2016, which is at page No.10, P.1 and submitted that she married the petitioner at her wish and choice without any coercion and pressure. Her photographs are at page No.11, which the petitioner admitted. On the last date of hearing i.e., 13.03.2017, she has submitted that her mother was unwell, therefore, she was with the parents till now.
4. Today, the above named Manaswitha is present in the Court and submits that she married the petitioner at her wish and choice. Now her mother is well and she wants to go with the petitioner and wants to live marital life with him.
5. As stated above, she was born on 05.04.1995 and thus she is a major. She has the liberty to lead her life as per her will and choice. If she wants to go with the husband, this Court cannot dictate her to go with the parents or with someone else.
6. We hereby make it clear that the respondents including respondent No.5, the father of the Manaswitha, his relations, near and dear, shall not interfere in the matrimonial life of the petitioner. We further make it clear that if the petitioner and his wife invite them, they can meet at any place, and if the respondent No.5 wants to give their marriage a social colour, he is at liberty, but till then, as desired by the wife of the petitioner, she will remain with the petitioner only.
7. In view of the above, this Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any pending, shall stand closed.
