THE HONOURABLE SRI JUSTICE M.LAXMAN CRIMINAL PETITION NO.4714 OF 2023 ORDER :

This petition is filed seeking anticipatory bail under Section 438 of Criminal Procedure Code, 1973 (Cr.P.C). The petitioners are accused Nos.4 and 9 in Crime No.178 of 2023 of Jadcherla Town Police Station, Mahabubnagar District. The offences alleged against the petitioners are Sections 143, 341, 324, 506 read with 149 of Indian Penal Code.

The sum and substance of case of the prosecution is that on 30.03.2023 at about 05.00 pm, the complainant, his wife and son were returning to home, after ploughing the field, accused Nos.1 to 10 were holding rods and stones allegedly attacked on the injured, his wife and son. Accused Nos.2 and 3 hit the injured on his head with rods. In the morning also, the accused persons obstructed the injured while they were ploughing the land. 3.

Heard learned counsel for the petitioners/accused Nos.4 and 9 and learned Public Prosecutor.

Learned counsel for the petitioners stated that accused Nos.1 to 3 and 8 were already enlarged on regular bail. Accused Nos.5, 6 and 7 were enlarged on anticipatory bail by the Court of the Judge, Family Court-cum-III Additional District and Sessions Judge, Mahabubnagar. The serious allegations are made only against accused Nos.2 and 3. The only allegation against the

petitioners/ accused Nos.4 and 9 is that they allegedly beat the complainant with hands. Except the said allegation, there is no serious allegation is made against the petitioners/accused Nos. 4 and 9. In the said circumstances, this Court is inclined to grant anticipatory bail to the petitioners/accused Nos.4 and 9. 6.

Accordingly, the Criminal Petition is allowed on the following terms and conditions:

(i) The petitioners/accused Nos.4 and 9 are enlarged on bail in the event of their arrest in connection with FIR No.178 of 2023 on the file of the Station House Officer, Jadcherla Town Police Station, Mahabubnagar District, on their executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties to the like sum each to the satisfaction of concerned Station House Officer.

(ii) The petitioners/accused Nos.4 and 9 shall appear before the Station House Officer, Jadcherla Town Police Station, Mahabubnagar District on every Sunday between 10.00 am and 05.00 pm, till completion of investigation and filing of final report.

(iii) The petitioners/accused Nos.4 and 9 shall abide by the other conditions stipulated in Section 438 (2) Cr.P.C and co-operate with the Investigating Officer in investigating the case.
