HONOURABLE SRI JUSTICE M.LAXMAN CRIMINAL PETITION NO.4715 OF 2023 ORDER :

The present application under Section 438 Cr.P.C is filed by the petitioners/accused Nos.2 to 5 seeking anticipatory bail in the event of their arrest in connection with Crime No.226 of 2023 of Punjagutta Police Station, Hyderabad District, registered for the offence punishable under Section 376(2)(n), 313 and 506 IPC. 2.

The case of the prosecution is that the present petitioners are the mother, brother-in-law, sister and uncle of accused No.1. The allegations shows that the victim was working with the accused No.1 who is Chartered Accountant and there was love affair between them and out of that affair, she conceived and accused No.1 allegedly manhandled and got pregnancy terminated against her consent and after termination of pregnancy, when the victim requested these accused to perform the marriage, they threatened the victim with dire consequences.

Learned counsel for the petitioners has contended that except the allegation of attracting ingredients of Section 506 IPC, there is no allegation against the present petitioners in respect of Sections 376 and 313 of IPC.

Learned Additional Public Prosecutor opposed the bail. 5.

In view of the nature of offences prescribed and further the petitioners are not staying in Hyderabad, this court is inclined to

grant anticipatory bail to the petitioners/accused Nos.2 to 5 on certain terms.

Accordingly, the Criminal Petition is allowed on the following terms and conditions:

(i) The petitioners - accused Nos.2 to 5 are directed to surrender before the Station House Officer, Punjagutta Police Station, Hyderabad, within a period of fifteen days from today and on such surrender, they shall be released on bail on their executing personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties for a like sum each to the satisfaction of the same Station House Officer.

(ii) that the petitioners/accused Nos.2 to 5 shall not tamper with the prosecution witnesses.

(iii) that the petitioners/accused Nos.2 to 5 shall co-operate with the investigating agency.

(iv) that the petitioners/accused Nos.2 to 5 shall not misuse the liberty granted to them.
