HON'BLE SMT JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.11970 of 2007 ORDER:

In this Writ Petition, petitioners question notification dated 26.05.2007, under Section 4(1) of the Land Acquisition Act, 1894 (the Act), issued by respondent No.1, in proposing to acquire various extents of their lands situate at Kondur Village, Tada Mandal, Nellore District.

This Court, while admitting the writ petition on 11.06.2007, stayed the impugned notification dated 26.05.2007.

Heard the learned counsel for the petitioners and learned Government Pleader for Land Acquisition. Today, when the matter is taken up for hearing, learned Government Pleader for Land Acquisition placed before this Court a letter dated 08.12.2017 of the Revenue Divisional Officer, Naidupet, wherein it is stated that the Tahsildar, Tada identified 48 beneficiaries, prepared layout and distributed house site pattas to the beneficiaries in Government lands in Sy.Nos.103, 104 and 102-6 of Kondur Village; and the lands of the petitioners are not required for acquisition. Since the lands of the petitioners are not required for providing house sites, no further orders need be passed in the writ petition.

The Writ Petition is, accordingly, closed. No order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
