ORDER
Heard learned counsel appearing for the petitioner, learned Government Pleader for Panchayat Raj appearing for respondents 1 and 2 and learned Government Pleader for Revenue appearing for respondent No.3.
The petitioner is a Upa-Sarpanch of Ismailkhanguda Village. Initially, she was elected as a member for Ward No.1 of the said village in the elections held in July, 2013. When a notice of no confidence motion dated 8.9.2017 was received by the petitioner from the 3rd respondent proposing to convene a meeting on 27.09.2017 along with a copy of resolution dated 26.07.2017 passed by the ward members of the Ismailkhanguda Village, the present writ petition is filed. There is no dispute with regard to the post held by the petitioner.
Learned counsel appearing for the petitioner submits that no opportunity was given to the petitioner before convening the meeting.
The said contention cannot be appreciated when the meeting is sought to be convened for the purpose of considering the motion of no confidence.
It is admitted that the petitioner received notice along with resolution proposed to be moved in the meeting. However, since the petitioner approached this Court by filing the present writ petition, this Court granted interim stay on 22.09.2017, as a result of which, the proposed meeting could not be held on 27.09.2017.
This Court does not find any merit in this writ petition. However, this Court is constrained to fix another date i.e., 21.10.2017 for considering the motion of no confidence against the petitioner. The Revenue Divisional Officer, Keesara Division-3rd respondent is directed to make necessary arrangements for convening the meeting of Gram Panchayat on the said date for considering the proposed resolution by the members of the Gram Panchayat.
Accordingly, the Writ Petition is disposed of. No costs. Miscellaneous petitions, if any, pending shall stand closed.
