THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.25437 of 2015 ORDER:

The petitioner was appointed as a fair price shop dealer of shop No.25, Vellaturu Village, Bollapalli Mandal, Guntur District. While so, on 03.07.2015, the Revenue Inspector inspected the shop of the petitioner and took away the records. It was followed by another inspection by the Deputy Tahsildar, Bollapalli on 08.07.2015. Though no irregularities, or variation in stock, were noticed, the shop was

locked as a result of which, the petitioner could not distribute the commodities for the month of July, 2015 which were delivered on 23.06.2015. The present Writ Petition is filed in order to enable him to distribute the essential commodities.

Learned Government Pleader for Civil Supplies, on instructions, submits that, though 6A proceedings were pending against the petitioner, no disciplinary proceedings were initiated. In the circumstances, the Writ Petition is allowed directing respondent Nos.2 and 3 to allow the petitioner to distribute the essential commodities to the cardholders by continuing him as dealer so long as his authorization subsists. Needless to observe that, so long as authorization of the petitioner is in force, the petitioner is entitled to distribute the essential commodities to the cardholders. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
