THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.12535 of 2012 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India for the following relief: "to issue writ, order or directions more in the nature of Writ of Mandamus to declare the action of the respondent Nos.1 to 3 & 5 are not taking steps on the proceedings No.TO/RWS/CRF/WT-Regn./2011-12, dated 30-03-2012 of the 4th respondent herein is bad, arbitrary, illegal, unjust, unreasonable and consequently direct the respondents to entrust the drinking water transportation work to petitioner society or any other person by calling open tenders immediately by keeping water scarcity in the Kollapur Mandal/ Constituency."

Heard and perused the material available on record. This Court while ordering notice on 26-04-2012 passed the following order:

"Notice before admission to the respondents, returnable in two weeks. Post after Summer Vacation, 2012. Meanwhile, the respondents are directed to give effect to the proceedings No.TO/RWS/CRF/WT-Reqn/201112, dated 30.03.2012 issued by the 4th respondent, and accordingly take up the relief works, as per the necessity, immediately, and see that there shall be no scarcity of drinking water."

Responding to the notice, a counter-affidavit is filed by the Mandal Parishad Development Officer, Kollapur, stating that the 2nd respondent immediately after assuming the charge of M.P.D.O., Kollapur on 17-04-2012 has totally implemented the directions of the 4th respondent for supply of drinking water in the three villages of Kollapur Mandal and the orders of the 4th respondent, dated 30-03-2012 was fully implemented.

In view of the above averments in the counter-affidavit filed by the 2nd respondent, nothing further survives for adjudication in this writ petition.

Accordingly, the writ petition is closed. There shall be no order as to costs.

The Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
