HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.36041 OF 2016 ORDER:

This Writ Petition under Article 226 of the Constitution of India has been preferred by the petitioner seeking to declare the inaction of the respondents in not considering the representation dated 02.02.2015 submitted by the petitioner to re-enquire into the acquisition of land in survey No.54 of Raja Bollarum, Medchal Mandal, the then Ranga Reddy District, and now in Medchal District, as illegal and arbitrary.

Heard the learned counsel for the petitioner, the learned Assistant Government Pleader for Revenue (TG) for respondent Nos.1 to 4. With their consent, the writ petition is disposed of at the stage of admission itself.

Though various grounds are raised, the learned counsel for the petitioner restricts his prayer seeking a direction to the respondents to dispose of of his representation dated 02.02.2015, which was subsequently renewed on 24.01.2016, 04.03.2016 and 22.08.2016.

Learned AGP opposes the Writ Petition contending that having received the compensation for the acquisition of part of the land, the petitioner cannot seek survey of the land again. A perusal of the material on record would show that petitioner claims to be holding land to an extent of Acs.9-20 gunts in survey No.54 situated at Raja Bollarum Village, Medchal Mandal. Out of Acs.9-20 guntas, about Acs.2.17 guntas was

acquired vide document No.6642/1988. The petitioner also admits the said fact. However, he submits that survey may be conducted for the remaining land held by him since the neighbours are raising disputes with regard to the same.

Having regard to the rival submission made, the petitioner shall make a suitable application in form 6-A along with requisite fee seeking survey, within a period of three weeks from today, before appropriate forum duly enclosing necessary documents, in which event, the same shall be dealt with in accordance with law as early as possible preferably within a period of six weeks from the date of filing of such application.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions pending in this writ petition, if any, shall stand closed.
