HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND THE HON'BLE SRI JUSTICE N.BALAYOGI WRIT PETITION Nos.11090, 11525 AND 10816 OF 2018 COMMON ORDER: (per V. Ramasubramanian, J) The petitioners in these writ petitions were aggrieved by the action of the respondents in not considering and accepting the community certificates produced by them, while seeking admission to Post Graduate Medical Degree/ Diploma for the academic year 20182019.

2. At the time when the writ petitions came up for orders for admission, the learned Standing Counsel for the University Mr.A.Pranhakar Rao, took notice. It was submitted by the learned Standing Counsel for the University that the Community Certificates produced by the petitioners are liable to be verified by the concerned authorities of the University, as the certificates were issued within their jurisdiction.

3. In the light of the said submission, this Court passed interim orders at that time in the above writ petitions, to the following effect: WP No.11090/2018:

" Mr. A.Prabhakar Rao, learned Standing Counsel, takes notice for the 3rd respondent.

It is stated by the learned Standing Counsel for the 3rd respondent that the Community Certificates produced by the petitioners are to be verified by the concerned authorities in Dr. NTR University of Health Science at Vijayawada, as the Certificates were issued within their jurisdiction. However, it is submitted by Mr. A.Satyam Reddy, learned Senior Counsel for the petitioners, that the 3rd respondent themselves may do the verification through Dr. NTR University of Health Sciences at Vijayawada.

Though it is possible for the 3rd respondent themselves to send the Certificates to Dr. NTR University of Health Sciences at Vijayawada for verification, the petitioners are actually running out of time. Therefore, it will be better and will be in the interest of the petitioners

themselves, if they produce the Community Certificates before the competent authority at the NTR University of Health Sciences at Vijayawada and get an authentication so that the same may be accepted by the 3rd respondent. Hence, a direction is issued to the Registrar, Dr. NTR University of Health Sciences at Vijayawada to have the Community Certificates produced by the petitioners verified and to issue an authentication regarding their genuineness. Once the genuineness is verified by them, the 3rd respondent shall accept the same and include the names of the petitioners in the merit list according to their own ranking.

WP No.11525/2018:

Mr. A.Prabhakar Rao, learned Standing Counsel takes notice for the respondents.

Following the similar orders passed in other writ petitions, the petitioners shall get the community certificates authenticated by the competent authority at Dr.N.T.R. University of Health Sciences, Vijayawada and produce the same before the 3rd respondent today itself. If the petitioners produce the same today, they will be considered in the counseling as belonging to the communities as reflected by certificates as produced.

WP No.10816 of 2018:

Heard Mr. S.Satyam Reddy, learned senior counsel for the petitioners. Mr. A. Prabhakar Rao, learned standing counsel takes notice for respondent No.3-University.

Since the petitioners have valid community certificates issued to them by the competent authorities in the State of Andhra Pradesh, they have to be treated as persons belonging to the respective reserved categories such as B.C. 'D', SC (W) (Madiga), B.C. 'E' and B.C. 'B', as per the certificates produced by them. Hence they will be an interim direction to the respondent No.3-University to treat the petitioners as belonging to the respective reserved categories, as reflected in the community certificates produced by them.

The petitioners shall be permitted to exercise the web options on the basis of the reserved categories to which they belong to. The respondent No.3-University is entitled to scrutinize the certificates, as per G.O.Ms. No. 58 SW (J) Dept., dated 12.5.1997 in accordance with the clause 4.1.1 of the prospectus. Post after two weeks."

4. Today it is submitted by the learned counsel for the petitioners that the petitioners produced their certificates and those certificates were verified and the applications of the petitioners were processed

further. Some of them got admission to PG Medical Degree/ Diploma course and some could not get, on the basis of the merit.

5. In the light of the above, nothing further remains for adjudication in the above writ petitions.

6. Hence, the writ petitions are closed. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed. No order as to costs.
