THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.11661 of 2016 ORDER:

This criminal petition is filed against the order of issuance of non-bailable warrant against the petitioner/accused in C.C.No.96 of 2014 on the file of the Court of V Additional Judicial First Class Magistrate, Guntur vide docket order dated 28.06.2016. Heard both sides.

Having regard to the facts and circumstances of the case, I am not inclined to quash the impugned order. However, it is open for the petitioner/accused to appear before the Court below and file an appropriate application, within one week from today, to recall the warrant. In such an event, the Court below shall dispose of the application of the petitioner on the same day on which it is filed on reasonable terms, in accordance with law. The Court below is directed not to execute the warrant for a period of one week from today.

The Criminal Petition is accordingly disposed of. Pending miscellaneous applications, if any, shall stand closed in consequence.
