THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.13117 of 2019 ORDER :

Heard learned counsel for the petitioner and learned Government Pleader for Forest.

Petitioner claims to be in possession and enjoyment of land to an extent of Acs.3.08 guntas in Sy.No.457 of Dharmapuram Village, Bayyaram Mandal, Mahabubabad District. Petitioner alleges that the Forest officials are trying to evict him without following the due process. In support of his claim that he is in possession, petitioner filed copy of Adangal for the years 2004 - 2005, 2005 - 2006 and 2006 - 2007. 3.

Learned Government Pleader, on instructions, submits that what is contended by petitioner is not true; that petitioner is not in possession of the subject land and some third parties are in possession and undertaking brick manufacturing activity and they were already issued notices.

Taking note of these submissions, the respondents are directed not to evict the petitioner, if he is in physical possession without following the due process. However, this order does not come in the way of respondents proceeding against the persons who are stated to be in occupation and against whom steps are being taken to evict. 5.

With the above directions, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
