Heard learned counsel for the petitioner, learned Government Pleader for Revenue and Sri G. Seshadri, learned Standing Counsel for respondent No.6. With their consent, the Writ Petition is disposed of at the admission stage itself.
2. Since the matter is not adjudicated on merits, this Court felt that it is not necessary to issue notice to respondent No.7.
3. The present Writ Petition came to be filed questioning the action of respondent Nos.5 to 7 in trying to lay road through the lands of the petitioner admeasuring Ac.0-07 cents and Ac.1-22 cents covered by Survey Nos.34/1A and 35/1, respectively, situated at Pacharumakulapalle Village, Kenchanaballa Post, Ramakuppam Mandal, Chittoor District, without following due process of law, as illegal and arbitrary.
4. Learned Government Pleader for Revenue as well as learned Standing Counsel for respondent No.6 submit that if the petitioner is the owner of the subject lands and the respondents intend to lay road through the lands of the petitioner, the respondents will follow due process of law.
5. Having regard to the aforesaid submission, the Writ Petition is disposed of directing respondents to follow due process of law, if they intend to lay a road through the subject lands, which the petitioner claims to be the owner.
