THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.11368 OF 2016

O R D E R

Heard Sri G.Vijaya Babu, learned counsel for the petitioners, and Sri D. Ramesh, learned standing counsel for the Capital Region Development Authority.

The prayer of the petitioners in this case is as under: 'For the reasons stated in the accompanying affidavit, it is therefore prayed that this Hon'ble Court may be pleased to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 2nd and 3rd Respondents in not considering and passing appropriate orders on the representation dated 03.03.2016 given by the Petitioner pursuant to the Form - 9.3 (Surrender Form) given by the Petitioners dated 05.09.2015 informing the Respondents 2 & 3 to take surrender of their land an extent of Ac.0.60 1/2 Cents in Survey No.

165 of Venkatapalem Village, Thulluru Mandal, Guntur District as illegal, arbitrary and violative of Article 14 of the Constitution of India and also violative of Principles of Natural Justice and consequently direct the Respondents 2 & 3 to take surrender of Ac.0.60 1/2 Cents in Survey No.165 of Venkatapalem Village, Thulluru Mandal, Guntur District as they are the owners of the above mentioned land and to pass such other order or orders as this Hon'ble Court may deems fit and proper in the circumstances of the case.'

As the petitioners' representation dated 03.03.2016 is awaiting consideration before the authorities concerned, this Court sees no purpose served in entertaining the writ petition for adjudication on merits. It is for the authorities concerned to apply their mind on the petitioners' representation and take appropriate action thereon. The writ petition is disposed of directing the authorities concerned to consider the petitioners' representation dated 03.03.2016 and take an appropriate decision thereon in accordance with law. This exercise shall be completed expeditiously and in any event, not later than six weeks

from the date of receipt of a copy of this order. Pending miscellaneous petitions shall stand closed in the light of this final order. No order as to costs.
