HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Criminal Petition No.4461 of 2015 ORDER:

The defacto complainant and her Counsel Sri Ch.Vidyasagar Rao are present. Accused and their Counsel Sri G.Shashidhar Reddy are present.

On the report given by the defacto complainant, the Police of Malakpet P.S, Hyderabad registered a case in Crime No.398/2014 against the accused for offences under Sec.324 and 506 IPC.

The brief facts of the FIR are that the complainant and her injured husband are staying as watchmen in the Shailaja Pride Apartment. One Sambaiah Naik along with his wife and children is staying in Flat No.201. While-so the accused used to visit the apartment frequently and the husband of complainant observed and informed to Apartment Secretary and warned accused not to visit the flat. On the night of 05.08.2014, the injured-watchman went out after stitching school bag and when he returned to apartment at 8:30pm, at that time the accused came there and attacked the watchman and caused injuries. The investigation is reported to be pending.

While-so, today the defacto complainant, her husband-G.Nageshwar Rao and accused along with their respective Counsel present before the Court and

submitted that at the intervention of elders, they have amicably resolved all their disputes and therefore, the defacto complainant has no objection for quashment of proceedings in Crime No.398 of 2014 of Malakpet P.S and hence, this Court may be pleased to accord permission to them to compromise the matter and compound the offence and accordingly quash the proceedings in Crime No.398 of 2014 of Malakpet P.S in the interest of justice.

Having regard to the above submission and in view of the fact that the parties are all known to each other and they want to lead a peaceful life in the apartment and also considering that no useful purpose will be served even if the investigation is ordered to be continued since the parties have already compromised the issue and by following the decision reported in Gian Singh vs. State of Punjab and another[1], this petition is allowed and permission is accorded to the parties to compound the offence and proceedings in Crime No.398 of 2014 of Malakpet P.S are hereby quashed in terms of joint memo filed by the parties.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
